Timeshare Presentation Lies
You are a victim of a timeshare scam in Mexico if you were told these statements at a sales presentation:
"...Our timeshare is a good financial investment."
TRUTH: The most widely cited industry rule of thumb indicates that most timeshares sell for 0% to 10% of original retail purchase price, with the majority falling at 0%. Other estimates put the realistic secondary-market range at 0%–15%, with many brands approaching $0. BBC research similarly notes many resellers recoup less than 30%
"...You can rent your timeshare weeks and make a profit."
TRUTH: Maintenance fee averages and growth. ARDA data shows the average billed maintenance fee was $1,550 per weekly interval in 2025**, up **4.7% from 2024** . The fee rose from **$1,090 in 2020 to $1,550 in 2025 — a 42% increase in five years** . For earlier context, the 2022 average was **$1,170 .
The rental-profit pitch also runs into developer rules. Most developer contracts restrict renting through third-party platforms or competing with the resort’s own rental inventory.
"...You can sell your timeshare anytime and make a profit."
TRUTH: Even after the timeshare is fully paid off, the owner remains liable for rising annual maintenance costs, which depresses resale value further.
Developer buyback is rare and usually not a buyback at all. Most timeshare developers do not buy back timeshares and never have. What some developers offer is a deed-back or surrender program — a voluntary return of the ownership interest that releases the owner from future fees, typically for $0 refund of the purchase price. Eligibility usually requires the loan to be fully paid off and fees current, and some developers charge a fee to accept the deed or reserve the right to refuse it.
"...XYC Company will buy your old timeshare for a considerable amount of money."
TRUTH: This is the advance-fee resale scam pattern. The FTC describes the mechanism: a company claims to have a buyer, then charges “taxes” or “closing costs” upfront — hundreds or thousands of dollars — before any sale occurs. Forbes reports that most of these companies charge upfront fees between $2,500 and $10,000. In one prosecuted case, operators charged owners up to $2,500 in advance and never sold a single timeshare interest.
The FTC’s consumer guidance is unambiguous: “Only scammers demand fees before they help you sell your timeshare” — never pay for a promise. The FTC has previously mailed refund checks to 8,088 consumers defrauded in a timeshare resale scheme, totaling nearly **$2.7 million**, with defendants charging up to $2,500 upfront.
"...Our timeshare offers you exceptional benefits and discounts for airfare, car rental, cruises, hotels or tours."
TRUTH: This claim is largely non-contractual, which is the key point. TCA notes that “over promising and under delivering is standard behaviour” in timeshare sales, and that “claims of guaranteed resale value, exclusive upgrades, or deeply discounted packages often conceal unreliable assurances” — none of which the contract is obliged to honor.
"...Our timeshare offers tax advantages."
TRUTH: Mortgage interest on a timeshare may be deductible only if the timeshare qualifies as a residence under tax rules, and maintenance fees for personal use are generally not deductible. The sales pitch typically presents this as a broad benefit when it is a narrow, conditional one. Consider consulting a tax professional for state-specific detail if you want to go deeper.
"...Our timeshare is a deeded or like a deeded property (perpetuity)."
TRUTH: The perpetuity is the obligation, not the asset. Points-based timeshare contracts often have no correlation to a real estate interest at all. There is no deed, no property title, and nothing to sell or inherit . For deeded timeshares, the “perpetuity” means the maintenance-fee obligation continues indefinitely and is inheritable, which is why “inherited timeshare” is its own consumer problem category.
The resale value of “property” with no liquid market is captured by the 0%–10% figure, and VOC’s analysis notes that the underlying interval has no liquid resale market even as fees rise.
