Timeshare Cancellation Rights: The Sales

Under Mexican law, the only way a company can make a timeshare sale in Mexico is by notifying the Industrial Development of Mexico Department as well as the Ministry of Commerce.

If the company hasn’t notified any of those departments, it is not authorized to sell timeshare properties.

Timeshare Cancellation Rights: The Standards

The Mexican Secretary of Tourism (SECTUR) governed some regulations that the Timeshare Resorts in Mexico must comply with.

Also, every Timeshare Organization must follow the requirements established by the National Registry of Tourism.

Those requirements specify that the resort is obligated to obey financial and safety standards.

Nonetheless, since the guidelines haven’t been changed since 1989, they don’t mention any conduct rules for the resort employees or consequences for dishonest sales practices.  

Timeshare Cancellation Rights: The cancellation period

According to the Mexican Consumer Protection Agency (PROFECO), which is the one that establishes the customer’s timeshare cancellation rights, the company must provide a 5-day rescission period, so the purchaser has the right to cancel the contract within 5 days since the timeshare agreement was signed.

This law was made in order to protect those consumers who are easily persuaded and make quick purchases without reading the complete contract.

If the contract does not mention the rescission period, and you have the documents to prove it, there’s a big possibility that the company will end up losing their license.

A client should be able to cancel the timeshare during the cooling-off period without any penalty.

Timeshare Cancellation Rights: After the cancellation period

    I have been an owner for about over a year, I have read comments and wondering about writing to Wyndham and stop paying. Ask for the deed in lieu, but do you have to pay the remaining balance? and what happens legally and fees? And we haven't even used our points or vacationed

    Anyone considering a timeshare should visit this site and get an education. There are ways that timeshares can be an incredible value, but never buy retail.

    This and the psychological training you went though would make good dinner conversation, don’t you think?

    Cannot tell you about Grand Mayan--hope someone else can help. I owned for many years at the Royal Resorts (Royal Mayan,Royal Islander) in Cancun for many years and these are first class ethical operations. I only sold because can no longer tolerate Cancun.

    I agree with the majority of comments. All the hidden fees, etc. I wish I could find a way to eliminate all the transfer on the spot scams.

    I agree that you should not pay any fee to anyone for a cancellation, the fee must be paid once the contract has been canceled, otherwise you could end up with two problems instead of one.

    Timeshares are an okay option for travelers. However, timeshares have gain a bad reputation for several reasons, some salespeople´s lack of ethics, rental and resale companies offering profits for marketing timeshares and, believe it or not, companies offering relief for unwanted timeshares by cancelling them.
