The process

1. The credit card company will post a temporary credit back to the client's account while the dispute is being processed.

2. The resort will be informed by the credit card company that the charge is being disputed on the basis of timeshare fraud.

3. The resort is required to show written proof of the client's acceptance of the terms of the contract.

In most timeshare scam cases, this works in the resort’s favor, as all the misrepresentations made are usually verbal promises.

The written contracts are carefully reviewed on a regular basis by the resort’s legal team to ensure that they cover their interests, and not  those of the clients.

4. Once the resort sends a copy of the written contract to the credit card company, in most cases, the credit card company is required to repost the charge back onto the client’s credit card.

Other clients who have rescinded their timeshare contracts within the 5-day cancellation period allowed by Mexican law, and filed a credit card dispute at the same time, have found that the dispute process can delay the refund process.

Normally, if a refund is approved by the resort, they will process it back to the credit card where the charge was initiated originally.

If the charge is already in the dispute, the resort will require the dispute to be finalized before any refund is made, in case the temporary credit back to the card by the credit card company becomes permanent.

This can delay the refund of the money and cause confusion for the timeshare scam victim.

In some cases, it can be advantageous to file a credit card dispute.

    We won! We requested cancellation by the credit card company. 2 months after we purchased the timeshare. They gave us a temporary credit - and requested documents from the timeshare. They provided a letter and documents. The company gave us an opportunity to respond. We responded and claimed fraud based on the fact that we did not receive the amenities in the unit they had shown us. I was able to prove based on the pictures. Also, the company was deceptive in their letter to the credit card company. I was able to prove their deception based on correspondence they had sent me. The credit card made the adjustment permanent and we received full refund of our downpayment.

    Hola, pase de igual forma muy mal trato por parte de el resort en donde tuve estos problemas ( pueblo bonito , cancun, mexico) involucrar tus tarjetas de credito con un tiempo compartido es la peor idea que pudimos aver tenido , todo por la desesperacion por querer librarnos de el.

    Hello , In my case was a ry diffcicult task to accomplish , like many people i was hooked up by a resort, and i go further buying a timeshare, my problem was to not read the full contract and now my credit card ispaying the consequences, just avoid all timeshare promises people.

    Timeshare complaints everywhere, my sister was scammed last year, by a mexican resort, mayan palace, those guys convinced my sister with tricky tactis to acquire some weeks, they promised many cool stuff, all was a insane lie, my sister lost a bunch of money with timeshare scam , such a shame .

    I dont believe on the credit card process, its a very risky thing, i had very bad experience on the "timeshares" try to avoid it please

    Be careful with companies that offer to resell your timeshare, especially ones that are charging money upfront. We certainly learned our lesson with that…goodbye 599 bucks. All of this mess has been full of b.s. We should have cancelled it when we had the chance. Is there anyway you guys can help us?

    Three simple rules to avoid timeshare resale scams: 1) Never pay ANY type of upfront fee.. 2) If they call you first- it's a scam! Legitimate brokers DO NOT telemarket! 3) Always find out the transfer process for your timeshare before you do anything! Your resort manager or owner services dept can tell you the procedure and give you an estimate of cost. Most of the telemarketing scams ask you to pay fake fees, closing costs, and taxes!

    It’s probably too late now, but my husband and I purchased a timeshare at the Hacienda Encantada in 2004. We’ve never been to the resort because its been under construction. The more and more I think about it the more I don’t want anything to do with it. They took my husband and I to the place of construction for breakfast and gave us both several drinks and the more we talked with the salesperson the better the idea sounded. We were both only 19 at the time and I feel we were taken advantage of. Is there anything we can do about it now?!?

    do never ever buy a timeshare package with sol melia or rci! it is not serious!
