A timeshare lawyer is required when a dispute between a timeshare corporation and a consumer comes to a dead end and legal assistance or litigation is the only solution.

As a consumer, you must fully understand your rights and obligations, as most timeshare contracts are agreements of perpetuity.

Finding the best legal approach against the timeshare corporation is key to win or lose a case; therefore, your lawyer must know timeshare law in great extent.

Has your timeshare company broken the timeshare law?

Read the examples below as some timeshare developers use these business practices in their favor but might be illegal and should not be permitted in their agreements:

  • Special assessment fees are not specified in their contracts.
  • New restrictions on the unit size or usage of the timeshare intervals.
  • New policies that make the timeshare intervals difficult to use
  • New policies that make timeshare ownership less valuable
  • Promises of financial gain at the time of sale
  • Overly optimistic scenarios on how to use the timeshare interval

Timeshare lawyers in class action lawsuits

Timeshare lawyers represent consumers victims of timeshare fraud. It is becoming a common practice to spend thousands of dollars on a timeshare to find out that the membership is not as promised or new restrictions on usage are imposed in order to pressure consumers to spend more money upgrading their memberships.

Unfair changes to the Home Owner Association Rules and Regulations as well as excessive increments of timeshare fees affect a vast majority of timeshare consumers and should not be avoided.

Companies that engage in these kinds of practices with the intention of financial remuneration violate contractual agreements and therefore break timeshare laws.

Country and state timeshare laws; Jurisdiction

timeshare laws

Most states have timeshare laws that regulate selling practices of timeshare resorts. Understanding these laws can be frustrating for "John and Mary Smith".

Keep in mind that your timeshare falls under the jurisdiction of the state or country you purchased your timeshare from and not from where your home are.

If you are determined to engage in a legal battle with a timeshare developer, you might have to find a timeshare lawyer with the expertise of timeshare law in the state or country you purchased your timeshare at.

Timeshare lawyer's fees

Timeshare lawyers can help you fight against a timeshare company with the legal support you need.

However, their hefty price tag dissuades most people from hiring their services. Another disadvantage is that the payment structure of lawyers, in general, is by paying hourly fees in advance, commonly called retainer.

The reason Mexican Timeshare Solutions offers very competitive prices on timeshare cancellations is because we have timeshare lawyers on a retainer basis.

Their field of expertise is timeshare law.

Another aspect of being a client of MTS is that you are not obligated to pay for fees upfront or during the cancellation process; MTS collects for our service only when your timeshare has been cancelled, and you are satisfied with our service.

Avoid being scammed

timeshare scam

The decision to hire the services of an experienced timeshare lawyer is significant and should never be based merely on price or advertising claims; in fact, lawyers are prohibited from making any guarantees or estimates of success.

Walk away from any timeshare "rescue" or "relief" company that provides a money-back guarantee to cancel a timeshare contract.

Understand that once this company has your money, it is they who have the upper hand and not you anymore.

Bear in mind that the reason you are reading this article is that you paid upfront for a service that ended up not being what it was promised, such as a timeshare contract.

Then, Why should you trust a company who that using the same collection techniques as the timeshare company you have issues with?

My parents own not one, but two timeshares. To their credit, they use them every year, though they trade for other locations. Their intention (the last time it was stated) was to leave these to us kids one day. I have ZERO desire to own a timeshare. I’d never use it and paying maintenance fees and then fees to switch locations? Ummm, no thanks. I’ll just go on vacations the old fashioned way – you know, pick a location, pick a date, find lodging, etc.

unfortunately we have such problems too...
We paid for it and after few years of paying maintenance fee and NEVER USING that timeshare we stopped paying (figuring they might resale it to cover any expenses because of our bailing out). No such luck! Last week we got a letter from collection agency demanding 4 thousand $ more! So greedy!
NEVER BUY A TIMESHARE! You can always book any hotel anytime! It is a horrible experience!

Despite the bad reputation of the timeshare industry, you’ll wonder why there are still individuals who own a timeshare. I think it’s the timeshare sales presentation. Timeshare developers mostly present their resorts greatly without warning of the incoming liabilities that lie ahead.

BE Careful also about companies who say they will BUy your timeshare to RID you of the time share. Some of their sales men charge absorbitant rates and they show you an income statement for 5 years on how much you will save.. Of course you will save on maint , fees. but they cahrge you 1,500- 3000 upfront and they say that is used For closing fees. When i called my Time share they tols me my time share only costs 200 for closing fees. They want to make money on the time share to cover at least 3-4 years of main fees that you pay upfront if they indeed are legitimate and of course the salary of the salesman. That is too ,much! JUST BETTER IF YOU CANT SELL IT DONATE IT TO A FRIEND OR YORU CHURCH!

I am one of the dummy's who paid 2 times to get mine sold . No it isn't' sold . We haven't used it in years .1 reason is , when we purchased ours , pets were permitted . Now they aren't . We have a small dog , harmless , but still a pooch . For us , she can't go we don' t , I tried Pinnacle who supposedly sells for Bluegreen . Get this . I 'd give the plan to whom ever , just take it off my hands . NOBODY wants it for free . My income doesn't allow me to have it and then I can't use it . So far my son has taken it over. I don' like that idea too well . Push comes to shove I suppose I could sit in jail .I'm a short timer anyway .

it's important to ask for help, no one are going to win against the resorts alone.
